Calobee is not a medical application. It does not provide medical advice, diagnoses, treatment recommendations, or professional dietary guidance. All calorie estimates and nutritional data are approximations for general informational purposes only.

Do not use Calobee as a substitute for advice from a qualified physician, registered dietitian, or other licensed healthcare professional. Always seek professional medical advice before making changes to your diet, exercise regime, or health routine, particularly if you have or suspect you may have any medical condition.

1. Agreement to terms

By downloading, installing, accessing or using the Calobee application ("the App"), you confirm that you have read, understood and agreed to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms in their entirety, you must immediately stop using the App and uninstall it from your device.

These Terms constitute a legally binding agreement between you and Calobee. We reserve the right to update these Terms at any time. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of the service

Calobee is a personal nutrition and calorie tracking application designed to help users log food intake, monitor nutritional information, and track progress towards personal wellness goals.

The App uses AI-powered food recognition and third-party nutrition databases to provide calorie and macro-nutrient estimates. These are approximations derived from general population databases and AI pattern recognition. They are not individually verified, clinically tested, or certified as accurate for any specific person.

Calobee is a lifestyle and informational tool. It is not a regulated medical device, clinical nutrition service, or professional health platform.

3. Health and medical disclaimer — full

3.1 Not medical advice

The content, features, and data provided by Calobee — including but not limited to calorie targets, macro-nutrient breakdowns, BMR calculations, weight loss projections, dietary tips, and nutritional information — are provided for general informational and lifestyle tracking purposes only. Nothing in the App constitutes:

  • Medical advice, diagnosis, or treatment.
  • Professional dietary or nutritional counselling.
  • A personalised health plan or therapeutic programme.
  • A substitute for consultation with a qualified healthcare professional.

3.2 Accuracy of estimates

All calorie and nutritional values displayed in the App are estimates. Actual nutritional content of foods varies significantly depending on preparation method, brand, portion size, regional variation, and individual metabolic differences. Calobee makes no representation or warranty that the values shown are accurate for your specific situation.

The calorie goal calculated by the App (using the Mifflin-St Jeor formula or similar) is a population-level estimate and may not reflect your individual metabolic rate, medical status, or specific energy needs.

3.3 AI food recognition limitations

The food recognition feature uses AI image analysis to identify foods in photos. AI recognition is inherently imperfect and may misidentify foods, underestimate or overestimate portion sizes, or fail to account for hidden ingredients, sauces, preparation methods, or regional food variations. You should always verify AI-generated estimates before relying on them.

3.4 Eating disorders and vulnerable users

Calorie tracking may not be appropriate for all individuals. If you have or have had a history of disordered eating, an eating disorder, or any condition that is adversely affected by monitoring food intake, please consult a qualified healthcare professional before using this App. If you experience distress as a result of using the App, stop using it and seek professional support.

3.5 Seek professional advice

Before making significant changes to your diet, calorie intake, or exercise programme — particularly if you are pregnant, breastfeeding, have diabetes, cardiovascular disease, kidney disease, or any other medical condition — consult a qualified physician or registered dietitian. Do not use Calobee as the sole basis for any health decision.

4. Limitation of liability

4.1 No liability for health outcomes

To the maximum extent permitted by applicable law, Calobee, its developers, directors, employees, partners and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • Any health outcome, injury, illness, weight change, or adverse physical or psychological effect resulting from use of or reliance on the App.
  • Inaccuracy or incompleteness of any calorie, nutritional, or fitness data displayed.
  • Decisions made on the basis of goals, recommendations, estimates, or information provided by the App.
  • Failure to achieve any weight loss, fitness, or health goal.
  • Misidentification of food items by the AI recognition feature.

4.2 No liability for technical issues

Calobee shall not be liable for:

  • Loss of data due to device failure, app malfunction, or sync errors.
  • Temporary or permanent unavailability of the App or any of its features.
  • Errors, bugs, or interruptions in service.
  • Unauthorised access to your account or data resulting from your failure to maintain account security.

4.3 Cap on liability

To the extent that any liability is found to exist, Calobee's total aggregate liability to you shall not exceed the total amount you paid for the App in the twelve (12) months preceding the event giving rise to the claim.

4.4 Jurisdictional limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

5. No warranties

The App is provided "as is" and "as available" without warranty of any kind, whether express, implied, statutory or otherwise. Calobee expressly disclaims all warranties including, but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Warranties that the App will be uninterrupted, error-free, or free from viruses or other harmful components.
  • Warranties regarding the accuracy, reliability, completeness, or timeliness of any data, content, or results provided by the App.
  • Warranties that the App is suitable for any specific health, fitness, or dietary goal.

6. User responsibilities

6.1 Accurate data entry

You are solely responsible for the accuracy of the data you enter into the App. Calobee's calculations and estimates are only as reliable as the information you provide. Entering inaccurate data (such as incorrect weight, height, or food quantities) will produce inaccurate results for which Calobee bears no responsibility.

6.2 Acceptable use

You agree to use the App only for lawful, personal, non-commercial purposes. You agree not to:

  • Attempt to reverse-engineer, decompile, disassemble or otherwise derive the source code of the App.
  • Attempt to gain unauthorised access to any server, system or account associated with Calobee.
  • Use the App in any way that could harm, disable, overburden or impair its services.
  • Transmit any viruses, malware, or other malicious code.
  • Use the App to store or transmit unlawful, defamatory, or harmful content.

6.3 Account security

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at support@calobee.com if you suspect unauthorised use of your account. Calobee shall not be liable for any loss resulting from unauthorised use of your account where you have failed to keep your credentials secure.

7. Intellectual property

All content, design, trademarks, logos, code, and features of the App are the exclusive property of Calobee and are protected by applicable intellectual property law. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes only.

You may not copy, reproduce, distribute, publish, transmit, modify, or create derivative works from any part of the App without prior written permission from Calobee.

8. Third-party services

The App may use or integrate with third-party services (including AI food recognition and nutrition databases). These services are governed by their own terms and privacy policies. Calobee is not responsible for the accuracy, availability or conduct of any third-party service. Your use of third-party features is at your own risk.

Nutritional information is derived in part from public and open food databases, including USDA FoodData Central (public domain) and Open Food Facts, whose data is made available under the Open Database License (ODbL). These values are provided "as is" and may be incomplete or inaccurate.

9. Indemnification

You agree to indemnify, defend and hold harmless Calobee and its developers, officers, employees, agents and licensors from and against any claims, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of or reliance on the App or its content.
  • Your violation of these Terms.
  • Your violation of any applicable law or third-party rights.
  • Any data or content you submit to the App.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

You may stop using the App at any time and request deletion of your account and data via Manage Account. Upon termination, your licence to use the App immediately ceases.

11. Changes to the service

We reserve the right to modify, suspend or discontinue any part of the App — including features, pricing, or availability — at any time and without notice. Calobee shall not be liable to you or any third party for any modification, suspension or discontinuation of the service.

12. Force majeure

Calobee shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, power outages, internet disruptions, or third-party service failures.

13. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall continue in full force and effect.

14. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Calobee with respect to your use of the App, and supersede all prior agreements, representations and understandings, whether written or oral.

15. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be submitted to the competent courts of the Netherlands.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Subscriptions and billing

Calobee offers an optional auto-renewing premium subscription that unlocks features such as AI photo analysis and unlimited logging.

  • Billing. Subscriptions are sold through the Apple App Store. Payment is charged to your Apple ID account at confirmation of purchase. Apple is the merchant of record; we do not process or store your payment details.
  • Free trial. If a free trial is offered, any unused portion is forfeited when you purchase a subscription.
  • Auto-renewal. Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
  • Managing and cancelling. You can manage or cancel your subscription at any time in your Apple ID account settings. Cancellation takes effect at the end of the current billing period; access continues until then.
  • Price changes. We may change subscription prices; any change applies only to future billing periods and, where required, only after notice and your consent.
  • Refunds. Refunds are handled by Apple in accordance with the App Store terms. Your statutory withdrawal rights, where applicable, are not affected.
